Two new legal issues on misuse of RTI Act

1.Postal Department has refused to provide the waiting list of PA/SA result to Gaurav Gupta and non-disclosing of waiting list proves that ineligible candidates are enlisted in the waiting list through back door.
u/s 7(1) of the RTI Act,PIO has to explain such reason of rejecting request which has been provided u/s 8 and 9 of the act for rejecting request.But,no such reason has been explained in the present matter.
What information can’t be disclosed is already mentioned in the RTI Act,2005.u/s 8(1) of the act,there are ten grounds of not-disclosing but in these grounds,waiting list of a result has not been kept to not disclose.u/s 9 of the act,information relating to the infringement of copyrights of an individual can’t be disclosed.Information relating to the Official Secrets Act,1923 can’t be disclosed u/s 22 and information excepting violation of human rights and corruption relating to intelligence and security organization specified in second schedule of the act can’t be disclosed u/s 24 of the act.

2.ब्रजभूषण दूबेजी के सूचना आवेदन पर आयुक्त,वाराणसी का रवैया एक नया आरटीआई मामला है।यदि लोक सूचना अधिकारी इस तरह से घुमाकर आवेदक को परेशान करे तो इसके विरुध्द सूचना का अधिकार कानून,2005 में प्रावधान नहीं है।लेकिन यहाँ लोक सूचना अधिकारी यानि आयुक्त द्वारा की गई हस्तांतरण पर प्रश्न उठाया जा सकता है।आयुक्त को निर्विवाद रुप से ये मालूम था कि वरुणा व असि नदी गाजीपुर में नहीं बहने के कारण ये मामला गाजीपुर के जिलाधिकारी के क्षेत्राधिकार का नहीं है।इसलिए सूचना का अधिकार कानून की धारा 6(3) के तहत इस आवेदन को जिलाधिकारी को हस्तांतरित नहीं किया जा सकता था।आवेदन को जबरन या गलत जगह हस्तांतरित कर अधिनियम की धारा 7(1) के तहत सूचना देने के लिए निर्धारित 30 दिन (या हस्तांतरण की दशा में 30 दिन में धारा 6(3) के अनुसार 5 दिन जोड़कर) में सूचना नहीं देकर विलंब किया गया जिसे अधिनियम की धारा 7(2) के तहत सूचना देने से मना करना माना जाएगा।तदनुसार अधिनियम की धारा 19(1) के तहत प्रथम अपील या धारा 18(1) के तहत सूचना आयोग में सीधे शिकायत दायर कराया जा सकता है।हालांकि इस मामले में कानूनी विश्लेषण की आवश्यकता है इसलिए सूचना आयोग जाना बेहतर है।
