Joint Admission Committee(JAC),IISERs ने RTI Act के तहत IISERs में नामांकन के लिए तोनों चैनल किशोर वैज्ञानिक प्रोत्साहन योजना,JEE(ADVANCED) 2014 और स्टेट व सेन्ट्रल बोर्ड के माध्यम से वर्ष 2014 में चयनित अभ्यर्थियों का मेरिट लिस्ट और Aptitude test का रिजल्ट लिस्ट बिना कारण बताए देने से मना कर दिया है।इससे पूर्व IISER,भोपाल ये कहकर सूचना देने से मना कर दिया था कि सूचना उसके पास नहीं,JAC के पास उपलब्ध है लेकिन RTI Act का धारा 6(3) के तहत मेरा आवेदन को JAC को हस्तांतरित नहीं किया,जिसके विरुध्द केन्द्रीय सूचना आयोग में शिकायत दर्ज की गई है।

IISERs मेरिट व रिजल्ट लिस्ट सार्वजनिक नहीं करती है इसलिए जाहिर है कि Back door से अयोग्य अभ्यर्थियों का भी नामांकन होता है।RTI Act के तहत बिना कारण बताए मेरिट व रिजल्ट लिस्ट देने से मना करने के बाद अब इस घोटाला का प्रथम दृष्टया पता चलता है।इसलिए अब मैं सूचना देने से मना करने के विरुध्द केन्द्रीय सूचना आयोग और इस गड़बड़ी के विरुध्द केन्द्रीय सतर्कता आयोग में शिकायत करुँगा।

Question of Law

It has been replied that merit list/result list can’t be revealed.u/s 7(1) of the RTI Act,the public information officer has to explain the such reason of rejecting request which has been provided u/s 8 and 9 of the act for the purpose of rejecting request.But,no reason has been explained in the present matter in question.
What information can’t be revealed is already mentioned in the RTI Act,2005.u/s 8(1) of the act,there are ten grounds of not-revealing but in these grounds,result list and merit list has not been kept to not reveal.u/s 9 of the act,information relating to the infringement of copyrights of an individual can’t be revealed.Information relating to the Official Secrets Act,1923 can’t be revealed u/s 22 and information excepting violation of human rights and corruption relating to intelligence and security organization specified in second schedule of the act can’t be revealed u/s 24 of the act.
