जवाहर नवोदय विद्यालय,बिरौली,समस्तीपुर के छठीं,सातवीं और आठवीं के
छात्रों से प्राचार्य चिरंजीवी राय द्वारा जबरन वसूली की जा रही है।नया
पंखा लगाने और अन्य सामान का मरम्मत कराने के नाम पर छठीं के छात्रों से
1000 रुपये और सातवीं तथा आठवीं के छात्रों से 500 रुपये जबरन वसूली जा
रही है जबकि रुपये लेने के एवज मेँ रसीद काटकर नहीं दी जा रही है।नवोदय
विद्यालय में ऐसे किसी भी कार्य के लिए रुपये लेना गैर-कानूनी है क्योंकि
नवोदय विद्यालय भारत सरकार द्वारा निशुल्क संचालित है और ऐसे सभी कार्य
के लिए सरकारी फंड मिलती है।ये संभव है कि चिरंजीवी राय सरकारी फंड को खा
गया हो या खाने वाला हो और जो कार्य फंड के रुपये से करना था,वो कार्य
छात्रों से जबरन वसूली कर हो रहा है।छात्रों से जबरन वसूली कर उन्हें
आर्थिक और मानसिक रुप से प्रताड़ित किया जा रहा है जो अनुच्छेद 21 के तहत
प्रदत प्रताड़ना से मुक्त होकर जीने के मौलिक अधिकार और मानवाधिकार का हनन
तो है ही और साथ में प्राचार्य द्वारा जबरन वसूली करना लोक सेवक द्वारा
ठगी करना है जो IPC का धारा 409 के तहत दंडनीय अपराध है। मैंने इसके
विरुध्द 10 जगह शिकायत प्रेषित किया है जो नीचे प्रस्तुत है-

Sir

It has been brought to my notice by the student of Jawahar Navodaya
Vidyalaya,Birauli Samastipur,Bihar that Chiranjiwi Roy,Principal of
Jawahar Navodaya Vidyalaya,Birauli Samastipur,Bihar is forcibly taking
(What i should term is levying) Rs 500 from each male students of
class seventh and eighth and Rs 1000 from each male students of newly
admitted class sixth in the name of instituting new fans and repairing
other articles of the hostel.

Further,it is to inform you that taking money for any kind of work is
illegal because Jawahar Navodaya Vidyalaya is established by the Govt
of India and it is a school providing education free of cost and fund
is provided by Govt of India (by the Navodaya Vidyalaya Samiti) for
such works like instituting fans and repairing articles.

It appears that the fund provided for the these works has been chewed
up or is going to be chewed up by the said principal and by the way
of levying money from the students,he is now going to do those works
which were/are to be done by the fund provided.

He has given a task to the house master of all hostels to take money
from the students and submit before him.It has been informed by the
student that even receipt is not being provided to students and if
the receipt will be provided to students ,then it will be obvioused
that he has forcibly levied money from the students and that’s why
receipt is not being provided .

Grounds

This application is being filed on the following grounds:-

(i) Because there is no rule of taking money for such works as fund
is provided for such works but illegally he is levying money.

(ii) Because levying money from students is criminal breach of trust
by the public servant which is an offence under section 409 of the IPC
and it is also an offence under section 420 of the IPC.

(iii) Because students are forced to give money and forcibly levying
money is just an economic and mental harassment and same economic and
mental harassment is violation of article 21 which confers right to
freedom from torturing as included in right to life and thus it is
also a case of violation of human rights.

Prayers

In view of the above facts and circumstances,it is most respectfully prayed to

(i ) Prevent the illegal levy being imposed by the said Principal
against the students.

(ii) Order to lodge an FIR against the said principal under section
409 and 420 of the IPC after making an investigation from the
students of class 6,7 and 8 and their parents and also from the other
students.

(ii) Initiate departmental proceedings in accordance with the service
rules applicable to him after making an investigation from the
students of class 6,7 and 8 and their parents and also from the other
students.
