National Human Rights Commission Protected The Chairperson Of Bihar Human Rights Commission.

As you know that the Chairperson of Bihar Human Rights Commission closed my case forcibly without initiating enquiry ,examining witnesses and documents and listening my evidences.
This was totally the matter of Violation of my Human Rights by the Chairperson of Bihar Human Rights Commission by showing carelessness or protecting principal and other officers by the way of disposing my case

Accordingly ,i submitted my email complaint against the Chairperson of Bihar Human Rights Commission before National Human Rights Commission on 1.1.2013.You can read my this complaint on my article of dated-1.1.2013.

But the National Human Rights Commission has dismissed my case against the chairperson of Bihar Human Rights Commission by replying as under-

”On perusal of the complaint,it is seen that the complaint relate to the matter which is barred under Section 36(1) of the Act,hence the complaint is not entertainable by the commission,as per Regulation 9(iv) of the NHRC (Procedure) Regulations,1997.The complaint is filed and case is closed.”

Firstly you should know about Section 36 (1) of the Protection Of Human Rights Act,1993 and regulation 9(iv) of the NHRC (Procedure) Regulations,1997 as stated in above order.

Under Section 36 (1) of the Protection Of Human Rights Act,1993,there can’t be parallel proceedings before National Human Rights Commission and State Human Rights Commission.State Human Rights Commission can’t entertain (receive) any complaint which is already in pending before National Human Rights Commission or any commission and Similarly, National Human Rights Commission can’t receive any complaint which is already in pending before any State Human Rights Commission or any Commission and, under regulation 9 (iv) of the NHRC (Procedure) Regulations,1997,National Human Rights Commission can dismiss such complaint filed before him.

Now,as per the above provision,this can be said that if my case would be already under the consideration of Bihar State Human Rights Commission,then National Human Rights Commission (NHRC) would have the power to dismiss my complaint.But in contrast to this,my complaint had already been closed by Bihar State Human Rights Commission and thus nothing was in pending.

Secondly,this can be said that the complaint was filed against the chairperson of Bihar Human Rights Commission for the violation of human rights.Complaint was not filed against the principal ,which had been under consideration before State Human Rights Commission.So the complaint against chairperson of Bihar State Human Rights Commission was not under the consideration of the same Bihar Human Rights Commission.So as per Section 36(1) of the said act,my complaint can’t be barred for admission for hearing before the NHRC and can’t be dismissed under regulation 9(iv) of the NHRC by the NHRC.

By the above decision of National Human Rights Commission,this can be said that anyhow,anyway National Human Rights Commission closed my case to protect the chairperson of Bihar Human Rights Commission .

Now,this can be said that human rights are not conserved by National Human Rights Commission also.I filed complaint against chairperson of Bihar Human Rights Commission for the violation of my Human Rights.My complaint was independent,not related to complaint filed before Bihar Human Right Commission because I filed complaint against principal before this state commission,not against chairperson but by connecting my complaint in such way,National Human Rights Commission has humiliated my Human Rights.

As the writ petition has been filed before High Court against the decision of the Chairperson of Bihar Human Rights Commission,so now only High Court remains as a way of hope.

Laloo Yadav was arrested in fodder scam after the order of Justice S.N Jha and Justice S.J Mukhopadadhaya,double bench of Patna High Court.This is same Justice S.N Jha who closed my case forcibly being a chairperson of Bihar Human Rights Commission without initiating enquiry,examining witnesses and documents and listening my evidences.However,Mr. Justice S. N. Jha and Mr. Justice S. J. Mukhopadhyay were alleged to save DAG(Treasuries) Mr. B. N. Jha and A.G. Mr. P. K. Mukhopadhyay and by observing the all official records and media contents,i am agree that these two judges were involved to save their respective castemen in fodder scam.Even there was extreme pressure to arrest Laloo,so High Court ordered to arrest Laloo.

Moreover,he was found to attend reception party organized by Laloo Yadav and he was alleged by a Laloo’s agent that he had contacted Justice SN Jha to manage to quash CBI’s desire to take help of armed forces to arrest Laloo.

In Kanchal Bala Suicide Case,yesterday he ordered to initiate departmental action against current SP and DSP of Sitamarhi.

He ordered to take departmental action against a BEO who cancelled the appointment of a female teacher by stating her certificate forge.

He has issued a lot of orders to take action against a lot of officers from BDO to DM.

However,Govt didn’t listen his order and didn’t take action against any.Also,he only fulfilled his formality to order to take action because except the case of BEO,perhaps in all cases he only ordered to take action,didn’t order the Govt or concerned mininstry to inform him/commission on a particular date what action has been taken in light to his order passed.He didn’t initaite next hearing for this.This is diplomacy to protect corrupt officers in one hand and on other hand to show that he has verdicted against officers.

In my case,there was no pressure like case of Laloo,i was merely a boy alone in court room without lawyer or any,being accused in a strong allegation which make a people prejudiced without listening the matter and he did same wrong in my case to protect corrupt people.
